Overview

The operator of this Shopify storefront is Sugarwish, called "we," "us," or "our" below. Collectively, the site, merchandise, information, capabilities, tools, and functions are the Services. Using any part—whether as a visitor, customer, vendor, merchant, seller, or contributor—binds you to these Terms and the Privacy Policy. Do not proceed if either is unacceptable. Any feature introduced later is included under the then-current agreement.

Section 1 — Access and account

You represent that you are legally an adult in the jurisdiction of residence. You may consent to device use by your minor dependents. Any email, payment, invoicing, or shipment information requested for the Services must remain correct, complete, current, and lawfully furnished. You must safeguard the account and are accountable for its activity. It cannot be licensed, sold, given away, or otherwise transferred.

Section 2 — Products

The store aims for faithful product presentation, yet display hardware can alter images and color and we cannot assure an exact match or expected quality. At any time we may edit descriptions, modify offerings, end availability, or limit supply to selected people, territories, or jurisdictions. A legally barred offer is void. The Services carry no guarantee of meeting subjective expectations or receiving every correction.

Section 3 — Orders

Sugarwish treats each placed order as a customer's offer and reserves the choice to accept it. Our confirmation, following payment processing, marks acceptance. Please inspect the proposed purchase because later cancellation requests might not be accommodated. We will make a reasonable effort to advise you of a declined, modified, or cancelled order through the provided email, telephone, or billing address. We may aggregate and limit quantities tied to a person, home, account, card, address, reseller, or distributor. Only personal or household buying is authorized; see the Refund Policy.

Section 4 — Prices and billing

Discounts, promotions, and prices are subject to unannounced revision. A purchase is charged at the rate effective upon ordering and identified by the confirmation. Taxes and all shipping, handling, customs, or import amounts remain additional unless specifically included. Prices need not match a physical outlet or another operator's store. Promotion conditions govern their own conflict. Keep transaction and account records accurate, complete, and current, especially email and card numbers or expiration dates.

Section 5 — Shipping and delivery

We provide estimated, rather than guaranteed, shipping dates. Carrier disruption, customs processing, and other matters beyond our reasonable control may postpone delivery without liability to us. Transfer to the carrier also transfers ownership and loss risk to the buyer. The buyer bears destination duties, taxes, customs fees, and rules.

Section 6 — Intellectual property

Sugarwish and its affiliates or licensors retain rights in the Services and every protected component, including marks, brands, prose, graphics, photographs, reviews, audio, video, layout, design, and selection. Access is authorized for personal, noncommercial purposes only. Unless written consent is obtained first, content cannot be reproduced, modified, disseminated, displayed, performed, published, downloaded, stored, transmitted, transformed, licensed, sold, or commercially used. No additional IP right is conferred.

Section 7 — Optional tools

Some tools are furnished by independent providers and may be accessible without our input or supervision. We do not warrant, condition, endorse, or accept liability for them; access is strictly as-is and as-available. Use requires your own risk assessment and agreement to the provider's rules. These Terms likewise extend to tools, features, or resources added later.

Section 8 — Third-party links

Independent websites and third-party content or offers may be accessible through the Services. Their accuracy, safety, policies, goods, and performance are neither warranted nor our responsibility. You assume the consequences of dealing with them, including loss or damage. Consider the external terms before completing a purchase, and contact the relevant provider about any issue.

SECTION 9 - RELATIONSHIP WITH SHOPIFY

Sugarwish is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Sugarwish. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Sugarwish, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Sugarwish.

Section 10 — Privacy

Data practices for Sugarwish appear in our Privacy Policy. The Shopify-hosted platform additionally lets Shopify process information created by access or use, potentially in another jurisdiction. Consult our notice as well as the Shopify consumer privacy documentation.

Section 11 — Feedback

By sending suggestions, reviews, proposals, ideas, plans, or other feedback, you authorize worldwide and perpetual use under a royalty-free sublicensable license encompassing reproduction, modification, publication, distribution, display, and commercial application in every medium. We have no obligation to compensate, answer, or preserve confidentiality and may edit or remove submissions. Your contribution must respect third-party rights, be lawful and nondefamatory, contain no abuse, obscenity, malware, false identity, or misleading origin, and remain your responsibility.

Section 12 — Errors, inaccuracies, and omissions

Mistakes or missing details may occur in descriptions, prices, promotions, availability, offers, shipping fees, and travel times. We can amend or correct the information and cancel associated orders whenever discovered, even post-submission and without prior notice. Unless required by law, we need not continuously refresh or explain the Services; a stated date should not be read as an all-content update.

Section 13 — Prohibited uses

The Services cannot be used for unlawful or infringing activity; harmful, abusive, fraudulent, discriminatory, defamatory, intimidating, or harassing conduct; false information; spam or malicious software; tracking or gathering another person's data; phishing, pretexting, pharming, crawling, scraping, or security interference. Robots, AI, and other automated processes may not obtain, copy, monitor, or generate from content, and resale or exploitation is forbidden. Violations authorize termination or suspension.

Section 14 — Agents

Where a bot, crawler, automated agent, or similar mechanism represents a user, the operator warrants authority to bind the represented person, clear disclosure of agency, and truthful identity and contact information. The mechanism cannot bypass CAPTCHA, robots instructions, rate limits, or access protections; conceal its nature by human mimicry; or misstate why it is acting. We retain the right to suspend or terminate it under these Terms.

Section 15 — Termination

You may end the relationship by advising us that the Services are no longer wanted or simply ceasing all use. We can end it without notice upon an actual or suspected failure to comply. Termination may include denial of access and does not relieve payment or liability incurred beforehand. Any term designed to operate afterward survives.

Section 16 — Disclaimer of warranties

We do not represent that general information is complete, accurate, or timely; decisions based on it are yours. As far as law permits, offerings are delivered as is and as available without any express or implied warranty or condition—among them title, non-infringement, durability, merchantability or merchantable quality, and fitness for a specific purpose. No guarantee covers continuous, timely, secure, error-free use or accurate results, and the Services can be removed or suspended without warning.

Section 17 — Limitation of liability

No claim, whether framed in contract, negligence or another tort, strict liability, or any other doctrine, may recover from Sugarwish, affiliates, directors, officers, employees, representatives, contractors, suppliers, providers, licensors, Shopify, or its affiliates any direct, indirect, incidental, punitive, exemplary, special, or consequential loss, including lost profit, revenue, savings, data, or replacement cost, to the broadest lawful extent. It applies to Services, products, and linked content despite notice. Any nonwaivable liability is capped as law allows.

Section 18 — Indemnification

Third-party proceedings arising from your use, noncompliance with these Terms or incorporated documents, violation of law, or harm to another right are your indemnity obligation. It covers defense and protection of Sugarwish, Shopify, their partners, affiliates, officers, directors, employees, agents, contractors, licensors, providers, subcontractors, and suppliers from claims, liability, damages, loss, and reasonable counsel fees. We will notify you subject to a material-prejudice standard, retain control of defense and settlement, seek consent for nonmonetary obligations, and expect cooperation.

Section 19 — Severability

Any clause determined unlawful, void, or unenforceable shall operate to the maximum extent permitted before its defective portion is separated. The balance of the agreement remains binding.

Section 20 — Waiver and entire agreement

Our choice not to invoke a right immediately does not amount to waiver. These Terms and the Service policies and operating rules published with them form the exclusive agreement, replacing prior or contemporaneous statements, proposals, and understandings, spoken or recorded. An ambiguity receives no adverse construction solely based on who drafted it.

Section 21 — Assignment

You cannot move this agreement, a right, or an obligation to another party without prior written consent from us, and any attempt is void. We may make an assignment or transfer without obtaining your consent and without notice.

Section 22 — Governing law

Governing law is the law applicable at Sugarwish headquarters, disregarding conflict-of-laws doctrine, for both this agreement and separate arrangements through which Services are supplied. You and we agree to the venue and personal jurisdiction of the corresponding federal and state or territorial courts.

Section 23 — Headings

No substantive meaning follows from a heading, which is supplied solely for convenience.

Section 24 — Changes to these Terms

Current Terms may be consulted on this page. At our discretion, a revised or replacement provision may be posted, so return periodically to review. We will give the notice required for material changes and identify when they become effective. Remaining on the Services after posting indicates acceptance.
